There May Be Problems When Serving An Evict Tenant Notice

By Johnnie Soto

A person who owns property such as a home, apartment buildings, mobile homes etc. And rents them out is known as a lessor and the one who rents the property a lessee. Sometimes the lessor must serve an evict tenant letter to the lessee. A yearly lease is signed by the renter to protect the owner's interests if the tenant does not follow this lease which they signed entailing the rules and regulations.

Sometimes a landlord will create a lease on a month to month basis as well but this arrangement does not happen as often. In any event, the person who occupies the dwelling obligates him or herself by signing this lease to adhere to the stipulations within it. Certain rules defining property care as well as financial responsibility apply.

If an individual who has signed a lease does not uphold the guidelines within it then the landlord has the right by law to ask the renter to move out. This sometimes can lead to problems for the one renting the property. There have been known cases where renters have become very aggressive and created problems for the landlord.

The landlord must sometimes take the brunt of such things as damage to their property, loss of money expected from renters who choose not to pay, stolen items, and the like, which ends up costing the one renting a great deal of money to recover their losses. Unfortunately this occurs quite often.

The renter who chooses not to pay for past due rent ends up with a late notice and late charges being added to what they already owe. If this does not get paid to the owner of the property it usually ends up going to court and the renter will generally end up with court costs as well.

Landlords who must serve an evict tenant notice may experience difficulties in the process. Renters who may be having a hard time paying their rent on top of being told they must move out causes emotions to flare for lack of knowing where they would go if they got kicked out. Compassionate landlords will at times work with their renters if they see they are genuinely in a pickle but when it is a recurring incident they most always serve notice to go.
